Abstract

This research aims to analyze the legal challenges in Islamic investments and the capital market, as well as to offer solutions based on Islamic legal perspectives and applicable regulations. The study uses a qualitative approach with a normative juridical method. The subjects of the research include the regulations of the Islamic capital market, the DSN-MUI fatwas, and relevant legal cases. Data were collected through a literature study and analyzed using a descriptive-analytical approach. The findings indicate that the primary challenges in Islamic investments and the capital market encompass the misalignment of regulations with Islamic principles, the lack of understanding among market players, and the limited effective dispute resolution mechanisms. The proposed solutions include harmonizing regulations, enhancing the Islamic legal literacy of investors, and strengthening the role of supervisory authorities. This study contributes academically by enriching the literature on Islamic investment law and providing recommendations for regulators and practitioners in increasing legal certainty in the Islamic capital market.
